Several months have passed since reports surfaced about a disagreement between Eon and Amazon regarding the future of James Bond. The situation has taken an unexpected turn, as another party is now seeking to gain control of several trademarks associated with the iconic spy.

According to The Guardian, Austrian entrepreneur Josef Kleindienst has filed multiple “cancellation actions based on non-use” related to James Bond, with the aim of acquiring the rights to the character’s name. Under UK and EU law, a trademark’s ownership can be challenged if the original owner has not utilized it in a specific area for at least five years. Kleindienst argues that, aside from the 2021 film No Time to Die, the James Bond name has not been used in other categories such as “models of vehicles, computer programmes, electronic comic books, and electronic publishing.” Other trademarks that could be challenged include “James Bond Special Agent 007,” “James Bond 007,” “James Bond: World of Espionage,” and the character’s famous catchphrase “Bond, James Bond.”

The motivation behind Kleindienst’s desire to acquire the James Bond trademark is unclear, but as noted by The Guardian, he is a real estate agent and the largest European property developer in the United Arab Emirates (UAE). A spokesperson for the company indicated that Kleindienst has plans for the trademark should he succeed, and his complaint against Eon mentioned the absence of Bond-themed restaurants or cocktail lounges, suggesting a potential direction. This development is not entirely dissimilar from the ongoing dispute between Eon and Amazon, in which the tech giant proposed creating an entire Bond franchise, a idea that Eon, specifically producer Barbara Broccoli, strongly opposes.

Kleindienst filed his challenge on January 27, and Danjaq, the US-based company holding worldwide licensing rights to James Bond, has two months to demonstrate that it has indeed used the Bond trademark in the contested areas.
