Microsoft’s Digital Crimes Unit (DCU) is pursuing legal action to safeguard the integrity and security of its AI services. A complaint filed in the Eastern District of Virginia aims to disrupt cybercriminals who create tools designed to circumvent the safety protocols of generative AI services, including Microsoft’s, to produce harmful and offensive content. Microsoft continually strengthens its products and services against abuse, but cybercriminals persistently develop techniques to bypass security measures. This legal action sends a clear message: weaponizing AI technology will not be tolerated.

Microsoft’s AI services employ robust safety measures at the model, platform, and application levels. Court documents reveal a foreign threat actor group developed software exploiting exposed customer credentials from public websites. They aimed to unlawfully access accounts with generative AI services and manipulate their capabilities. These services were then resold to other malicious actors with instructions on generating harmful content. Microsoft revoked access, implemented countermeasures, and enhanced safeguards to prevent future malicious activity.

This activity violates U.S. law and the Acceptable Use Policy and Code of Conduct for Microsoft’s services. The unsealed court filings are part of an ongoing investigation into the creators of these illicit tools and services. The court order allows Microsoft to seize a crucial website, gather evidence, understand monetization strategies, and disrupt related infrastructure. Simultaneously, Microsoft has implemented additional safety mitigations and will continue strengthening its defenses based on investigation findings.

Generative AI tools empower creative expression and productivity. However, like other technologies, they attract malicious actors seeking to exploit them. Microsoft recognizes its responsibility to protect against misuse as new AI capabilities emerge. Last year, Microsoft committed to innovating user safety and outlined a comprehensive approach to combat abusive AI-generated content. This legal action reinforces that commitment.

Beyond legal actions and strengthening safety protocols, Microsoft proactively collaborates with partners to address online harms and advocates for laws empowering authorities to combat AI abuse, particularly harm to others. Microsoft’s recent report, “Protecting the Public from Abusive AI-Generated Content,” recommends industry and government actions to safeguard the public, especially women and children, from malicious actors.

For almost two decades, Microsoft’s DCU has combatted cybercriminals weaponizing everyday tools. The DCU now applies its cybersecurity expertise to prevent generative AI abuse. Microsoft remains dedicated to protecting people online, transparently reporting findings, taking legal action against those weaponizing AI, and collaborating across sectors to secure all AI platforms from harmful misuse.
