The investigation reportedly found that ByteDance violated <a data-i13n=\"cpos:3;pos:1\" href=\"https:\/\/www.engadget.com\/2016-04-14-eu-data-protection-rules.html\" data-ylk=\"slk:Europe&#039;s General Data Protection Regulation (GDPR) laws;cpos:3;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \" rel=\"nofollow noopener\" target=\"_blank\">Europe&#8217;s General Data Protection Regulation (GDPR) laws<\/a> by transferring private user data to China, where it could be accessed by engineers. China is notorious for its <a data-i13n=\"cpos:4;pos:1\" href=\"https:\/\/www.engadget.com\/2018-02-22-china-xinjiang-surveillance-tech-spread.html\" data-ylk=\"slk:widespread, high-tech surveillance;cpos:4;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \" rel=\"nofollow noopener\" target=\"_blank\">widespread, high-tech surveillance<\/a>.<\/p>\n<p>Former Irish Data Protection Commissioner Helen Dixon <a data-i13n=\"elm:context_link;elmt:doNotAffiliate;cpos:5;pos:1\" class=\"link \" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2021-03-10\/tiktok-may-be-sending-eu-data-to-china-its-data-watchdog-says\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:said;elm:context_link;elmt:doNotAffiliate;cpos:5;pos:1;itc:0;sec:content-canvas\">stated<\/a> in March 2021, when the investigation began, &#8220;TikTok tells us that EU data is transferred to the U.S. and not to China, however, we have understood that there is a possibility that maintenance and AI engineers in China may be accessing data.&#8221;<\/p>\n<p>Ireland is taking the lead in this matter because, under the GDPR, the country where a company&#8217;s European operations are located is responsible for overseeing compliance and enforcement. ByteDance&#8217;s European headquarters are located in Dublin. <em>Bloomberg<\/em> reports that the decision date and amount of the fine have not been finalized and may still change.<\/p>\n<p>Meanwhile, this is not the only challenge ByteDance is facing.
